Online Bulk PAN Verification

Friends,

Now a days PAN (Permanent Account Number) of Income Tax is required almost in every transaction/need. So there comes a problem to check the PAN supplied whether it is correct or wrong because if someone has provided wrong PAN then all the further transactions will be done on this wrong PAN and at the end of the Financial Year there will be a great problem when you issue Form 16 or Form 16A which is applicable and that will not match with the Income Tax Department record in the shape of form 26AS. So to enable eligible Entities verify Permanent Account Numbers (PANs), Income Tax Department (ITD) has authorized National Securities Depository Limited (NSDL) to launch an online PAN verification service for verification of PANs by authorized entities.

Entities who can avail of this facility:

    Department of Commercial Taxes
    Government Agencies (Central/State)
    Reserve Bank of India
    Banks
    Depositories
    Depository Participants
    Mutual Funds
Companies (Required to furnish Annual Information Return)
    Credit card Companies / Institutions
Any other entity required to furnish Annual Information Return
    Stock Exchanges
Companies and Government deductor (Required to file TDS/TCS return)

Service

This service has three modes of verification:

(1) Screen based verification
(2) File based verification
(3) Software (API) based verification

(1) Screen based verification:

The users, after login, can furnish up to a maximum of five PANs in the screen provided. The PANs may be entered in the boxes provided in the screen and then submitted. The response giving details of PAN will be displayed in the response screen.

(2) File based verification:

The users, after login, can upload a file containing maximum of 1000 PANs (file structure as specified by NSDL). The site will make available, within 24 hours, a response file containing details of the PANs. In case, file format is incorrect, the system will convey the rejection within 24 hours. The entity can download the response at his convenience up to 15 days.

(3) Software (API) based PAN verification:

The facility is an interface that allows the user to make an online verification of PAN by accessing the verification-site through a software application.

Response to the User

In case of valid PAN, name of the PAN holder, last date of PAN update as per ITD database and the status as “existing and valid” will be displayed. If the PAN is a fake PAN as per ITD database, the status will be shown as “Fake PAN”.

In case where category of user is Department of Commercial Taxes, valid PAN, name of the PAN holder, Date of Birth, father’s name and last date of PAN update as per ITD database and the status as “existing and valid” will be displayed. If the PAN is a fake PAN as per ITD database, the status will be shown as “Fake PAN”

In case the PAN is not found in database, the response will be “not in ITD database”. In such cases, if the user is able to provide a proof of this PAN (copy of PAN card or PAN allotment letter), NSDL will forward the same to ITD for investigation.

Capital Gain on Sale and Purchase of Two Houses - Exemption ?

Friends,

If someone has sold two houses and purchase two houses as well then what will be effect of Capital Gain in this process and how much exemption one can claim. India-capital-gains-exemption Income Tax Tribunal, Mumbai  in case of Rajesh Keshav Pillai vs ITO [2011] 44 SOT 617 while deciding the issue the quantum of exemption u/s 54 held that  in case there is sale of more than one residential house, the exemption will be available in relation to each set of sale and corresponding investment in the residential house

Fact of the Case

The assessee owned two flats being the flat Nos. 41 and 51 in Shikha Building, Pali Hill, Bandra (West). Both the flats had been purchased on 5-1-2001. The flat No. 41 was sold by the assessee on 16-6-2005 for a sum of Rs. 1,01,00,000 and the flat No. 51 had been sold on 29-4-2005 for a sum of Rs. 97,79,500. The assessee had thus earned income on account of long-term capital gain from sale of two flats in assessment year 2006-07. The indexed gain in respect of flat No. 41 was Rs. 88,55,558 whereas the indexed gain in respect of the flat No. 51 was Rs. 85,55,508. The assessee invested the gain on sale of flats in two different flats i.e., flat in Sai Dham at Govind Patil Road for Rs. 81,57,624 and flat at Girnar 55, Pali Hill for a sum of Rs. 95,71,364. The total investment in two flats was Rs. 1,77,28,988 which was more than the total index gain on sale of two flats of Rs. 1,74,17,617. The assessee, therefore, claimed the entire capital gain as exempt under the provisions of section 54.

The Tribunal Held
We are in full agreement with the decision of the Special Bench that exemption in respect of sale of a residential house will be available only when there is corresponding investment in one residential house. But the exemption will be available in respect of sale of any number of residential houses if there are corresponding investments in residential house and all other conditions are fulfilled. Thus in case there is sale of more than one residential house, the exemption will be available in relation to each set of sale and corresponding investment in the residential house. However, we are unable to agree with the plea of the assessee that exemption has to be calculated considering the aggregate of capital gain and aggregate of investment in the residential houses. In case there are sales of more than one residential houses, in our view exemption has to be computed considering each set of sale of residential house and the corresponding investment in one residential house and the combination which is beneficial to the assessee has to be allowed. In this case the learned AR has submitted that indexed gain of Rs. 88,55,558 in respect of sale of flat No. 41 should be considered against the investment in flat at Girnar for Rs. 95,71,364 which is allowed and the investment being more entire indexed gain of Rs. 88,55,558 in respect of sale of flat No. 41 will be exempt. The indexed gain of Rs. 85,55,508 in respect of sale of flat No. 51 will have to be considered against the investment of Rs. 81,57,624 in the flat at Sai Dham. Since the investment is less than the capital gain, difference of Rs. 3,97,434 will have to be taxed. We hold accordingly.
In nutshell
  1. Exemption can be claimed for each house sold .
  2. Exemption u/s 54 can be claimed for each house sold with respect to investment made in another house.
  3. Exemption u/s 54 can not be claimed by aggregating the sale value and deducting the aggreagte of investment in houses.

Anna Hazare can be Hospitalized Today

Friends,

The movement to implement the Jan Lok Pal bill has entered into the Seventh day. Sh. Anna Hazare's health has become a serious issue. Doctors said the Gandhian leader was in the "danger zone" and may require urgent hospitalization in the next 24 to 48 hours. Hazare's weight is down to 67 kg from 72 kg; he has lost five kg in seven days, his blood pressure is 130/80 and pulse rate 90, according to the health bulletin. The longest he has fasted previously is 12 days.

When contacted, cardiologist Dr Naresh Trehan, who is leading a team monitoring Hazare's health, said, "His condition is not life-threatening is what I can say." But there is a rise in ketone levels - presence of certain acids and acetone in blood and urine - which means the body is breaking down stored fat instead of the usual glucose.

Dr Anoop Misra of Fortis hospital told TOI, "The patient has already entered the danger zone. He will need medical attention within the next 24-48 hours. The fast may affect the heart, kidney and blood pressure depending upon how fast Anna's ketone level rises."

While Hazare does not yet require hospitalization, his failing health complicates the Centre's political risk as any mishap will prove catastrophic for the Manmohan Singh government. But removing the fasting leader for forced-feeding from Ramlila maidan or administering it there is a fraught job, not the least because of 24x7 media coverage of the protest.

Increased ketones levels are caused by fasting or starvation when the body is deprived of carbohydrates. Persistent high levels after a prolonged hunger strike can harm kidney function. Despite increased water intake, the 74-year-old Gandhian's health condition is deteriorating and he is very weak. He has discontinued morning yoga and has been advised to speak less.

Sources said if Hazare's condition was not rectified, he might soon require hospitalisation to administer insulin intra-venous fluid. "Due to starvation, the ketone levels have increased. Ketone, organic compounds that are acidic in nature, are produced when the body burns fat. It can prove to be life-threatening and affect his brain consciousness, heart and kidney functioning. Urine production is also affected," said a source.

Hazare has earlier declared that if the government tries to force feed him or admit him to a hospital against his wishes he would give up water intake as well. Hazare group member Kiran Bedi said the government remained unconcerned and claimed that there was no response to the suggestion to appoint a negotiator.

Although the government is keen to reach a middle ground, it is unwilling to concede team Hazare's demand that its version of Lokpal be legislated forthwith and the examination of the government draft be short-circuited. Yet, the health dimension adds a sense of urgency to the government's efforts to reach a deal with the activists.

Resumption of Parliament on Tuesday will also worry the government as the Opposition is likely to bring up the health aspects of the fasting Gandhian even as there are clear signs of mounting unease among Congress MPs with some like Sanjay Nirupam, Priya Dutt and Dutta Meghe saying they support Hazare's anti-corruption objectives.

Jan Lokpal Bill vs Govt Lokpal bill (Hindi Version)

Friends,

Jan Lokpal Bill vs Govt Lokpal bill (English Version)

Friends,

Sh. Anna Hazare, a 74 year old man is struggling for our rights then why not we should support him. There is no personal motive of Sh. Hazare in this movement. Friends its the right time to wake up. Let us give our 100% in the support of Sh. Hazare to force Government to Pass the Jan Lok Pal Bill. Jan Lokpal Bill- a law being made by the people and for the people!

Jan Lokpal Bill is being further refined through Public Participation! Many big and small meetings are taking place across the country and suggestions are pouring in on various aspects of the law.

It is crucial that every citizen of India understands what Jan Lokpal Bill is all about and how it will help curb corruption.

English Pamphlet

See how Lokpal Bill can curb the politicians

Dear All,

Please go through the details carefully & try to be part of this mission against corruption. Things to know about Anna Hazare and Lok pal Bill-:

1.Who is Anna Hazare?
An ex-army man(Unmarried). Fought 1965 Indo-Pak War.
2.What's so special about him?
He built a village Ralegaon Siddhi in Ahamad Nagar district, Maharashtra
3.This village is a self-sustained model village. Energy is produced in the village itself from     solar power, biofuel and wind mills. In 1975, it used to be a poverty clad village. Now it is one   of the richest village in India. It has become a model for self-sustained, eco-friendly & harmonic village.
4.This guy, Anna Hazare was awarded Padma Bhushan and is a known figure for his social activities.
5.He is supporting a cause, the amendment of a law to curb corruption in India.
6. How that can be possible?

He is advocating for a Bill, The Lok Pal Bill (The Citizen Ombudsman Bill), that will form an       autonomous authority who will make politicians (ministers), bureaucrats (IAS/IPS) accountable for   their deeds.
7. It's an entirely new thing right..?

In 1972, the bill was proposed by then Law minister Mr. Shanti Bhushan. Since then it has been       neglected by the politicians and some are trying to change the bill to suit their theft             (corruption).
8. Oh.. He is going on a hunger strike for that whole thing of passing a Bill ! How can that be possible in such a short span of time? The first thing he is asking for is: the govt should come forward and announce that the bill is going to be passed. Next, they make a joint committee to DRAFT the LOK PAL BILL. 50% government participation and 50%   public participation. Bcoz u can't trust the govt entirely for making such a bill which does not suit them.

9.What will happen when this bill is passed?

A LokPal will be appointed at the centre. He will have an autonomous charge, say like the Election   Commission of India. In each and every state, Lokayukta will be appointed. The job is to bring all alleged party to trial in case of corruptions within 1 year. Within 2 years, the guilty will be punished.

See how Lokpal Bill can curb the politicians, Circulate it to create awareness

      Existing System
System Proposed by civil society
No politician or senior officer ever goes to jail despite huge evidence because Anti Corruption Branch (ACB) and CBI directly come under the government. Before starting investigation or prosecution in any case, they have to take permission from the same bosses, against whom the case has to be investigated.
Lokpal at centre and Lokayukta at state level will be independent bodies. ACB and CBI will be merged into these bodies. They will have power to initiate investigations and prosecution against any officer or politician without needing anyone’s permission. Investigation should be completed within 1 year and trial to get over in next 1 year. Within two years, the corrupt should go to jail.
No corrupt officer is dismissed from the job because Central Vigilance Commission, which is supposed to dismiss corrupt officers, is only an advisory body. Whenever it advises government to dismiss any senior corrupt officer, its advice is never implemented.
Lokpal and Lokayukta will have complete powers to order dismissal of a corrupt officer. CVC and all departmental vigilance will be merged into Lokpal and state vigilance will be merged into Lokayukta.
No action is taken against corrupt judges because permission is required from the Chief Justice of India to even register an FIR against corrupt judges.
Lokpal & Lokayukta shall have powers to investigate and prosecute any judge without needing anyone’s permission.
Nowhere to go - People expose corruption but no action is taken on their complaints.
Lokpal & Lokayukta will have to enquire into and hear every complaint.
There is so much corruption within CBI and vigilance departments. Their functioning is so secret that it encourages corruption within these agencies.
All investigations in Lokpal & Lokayukta shall be transparent. After completion of investigation, all case records shall be open to public.  Complaint against any staff of Lokpal & Lokayukta shall be enquired and punishment announced within two months.
Weak and corrupt people are appointed as heads of anti-corruption agencies.
Politicians will have absolutely no say in selections of Chairperson and members of Lokpal & Lokayukta. Selections will take place through a transparent and public participatory process.
Citizens face harassment in government offices. Sometimes they are forced to pay bribes. One can only complaint to senior officers. No action is taken on complaints because senior officers also get their cut.
Lokpal & Lokayukta will get public grievances resolved in time bound manner, impose a penalty of Rs 250 per day of delay to be deducted from the salary of guilty officer and award that amount as compensation to the aggrieved citizen.
Nothing in law to recover ill gotten wealth. A corrupt person can come out of jail and enjoy that money.
Loss caused to the government due to corruption will be recovered from all accused.
Small punishment for corruption- Punishment for corruption is minimum 6 months and maximum 7 years.
Enhanced punishment - The punishment would be minimum 5 years and maximum of life imprisonment.

All about TAN - Tax Deduction Number

Friends,

Now a days Income Tax Department is very much keen to keep your Income Tax record handy. Each and every type of effort is being made by the Income Tax department to make easy regarding tax. But it could not be done by the department itself. It is very much necessary on the part of deductor to Deposit the tax on time and into his TAN properly. Here are some major points regarding TAN.

The Tax Dedcution Number(TAN) is very important now because most of the persons , even Individuals and HUF having sales turnover above Rs 40 lacs or having professional receipts above rs 10 lacs are made responsible for dedcution of tax at source in many kind of payments. Therefore, I am giving below the FAQ on TAN published on www.incomtaxindia.gov.in and http://tin.nsdl.com for the help of all who wants to know about TAN.
1. What is TAN?
TAN or Tax Deduction and Collection Account Number is a 10 digit alpha numeric number required to be obtained by all persons who are responsible for deducting or collecting tax. It is compulsory to quote TAN in TDS/TCS return (including any e-TDS/TCS return), any TDS/TCS payment challan and TDS/TCS certificates.
2. Who must apply for TAN?
All those persons who are required to deduct tax at source or collect tax at source on behalf of Income Tax Department are required to apply for and obtain TAN.
3. Why to apply for TAN?
The provisions of section 203A of the Income-tax Act require all persons who deduct or collect tax at source to apply for the allotment of a TAN. The section also makes it mandatory for TAN to be quoted in all TDS/TCS returns, all TDS/TCS payment challans and all TDS/TCS certificates to be issued. Failure to apply for TAN or comply with any of the other provisions of the section attracts a penalty of Rs. 10,000/-.
4. Why is it necessary to have TAN?
TAN is required to be quoted in all TDS/TCS returns, all TDS/TCS payment challans and all TDS/TCS certificates to be issued. TDS/TCS returns will not be received if TAN is not quoted and challans for TDS/TCS payments will not be accepted by banks. Failure to apply for TAN or not quoting the same in the specified documents attracts a penalty of Rs. 10,000/-
5. How to apply for TAN?
An application for allotment of TAN is to be filed in Form 49B and submitted at any of the TIN Facilitation Centres meant for receipt of e-TDS returns. Addresses of the TIN FC are available at www.incometaxindia.gov.in or http://tin.nsdl.com.

TAN is allotted by the Income Tax Department on the basis of the application submitted to TIN Facilitation Centres managed by NSDL. NSDL will intimate the TAN which will be required to be mentioned in all future correspondence relating to TDS/TCS.

The application is also available at TIN Facilitation Centres.
9. Can form 49B be filled on a typewriter?
Yes. But typing should be in capital letters with good impression.
10. What are the documents that need to accompany the TAN application?
No documents are required to be filed with the application for allotment of TAN. However, where the application is being made online, the acknowledgment which is generated after filling up the form will be required to be forwarded to NSDL. Detailed guidelines for the procedure are available at http://tin.nsdl.com
11. What if incomplete form 49B is submitted?
The TIN Facilitation Centre will assist the applicant to correctly fill up Form 49B but shall not receive incomplete or deficient application.
12. What is the fee for filing application for TAN?
The applicants for TAN are to pay Rs.50/- + service tax (as applicable) as processing fee at the TIN FC at the time of submitting Form 49B.
13. How will the new TAN number be intimated to the deductor?
NSDL will ensure intimation of new TAN at the address indicated in the Form 49B or against the acknowledgement in case of online applications for TAN.
14. How can a deductor know his TAN if he has an old TAN, or if he has earlier applied for TAN but hasn’t got TAN?
TIN Facilitation Centres will help the deductors in ascertaining their correct TAN from the database. TAN can also be verified from the information on the website of Income Tax Department at www.incometaxindia.gov.in. There is a search engine to find new TAN against old TAN or to find new TAN against name and address of the deductor.
15. What happens in a situation where a deductor does not have TAN or has a TAN in old format?

16. Is it necessary to apply for different TAN if a deductor has to deduct tax from different types of payments like salary, interest, dividend etc.?
No. TAN once allotted can be used for all type of deductions. It can also be used in case tax is being collected at source also.
17. Is a separate TAN required to be obtained for the purpose of Tax collection at Source?
In case a TAN has already been allotted, no separate application needs to be made for obtaining TAN. The same number can be quoted in all returns, challans and certificates for TCS. 22. What is duplicate TAN?
Duplicate TAN is a TAN which has been inadvertently obtained by a same person who is responsible for deducting/collecting tax and who already has a TAN allotted to him earlier. It is illegal to possess or use more than one TAN. Different branches/divisions of an entity may, however, have separate TAN.
23. In case duplicate TAN has been allotted, which TAN should be used?
In case duplicate TANs have been allotted, the TAN which has been used regularly should be used. The rest of the TANs should be surrendered for cancellation using “Form for Changes or Correction in TAN” which can be downloaded from the website of NSDL (http://tin.nsdl.com).
24. What do we have to do if we have been allotted a duplicate TAN by oversight?
In case duplicate TAN has been allotted, an application may be made for cancellation of the TAN which has not been used in the “Form for Changes or Correction in TAN” which can be downloaded from the website of NSDL (http://tin.nsdl.com) or printed by local printers or obtained from any other source. The application is also available at TIN Facilitation Centres.
25. Can we quote PAN in place of TAN? Why not?

Ans. No. PAN should never be quoted in the field where TAN is required to be quoted. The purposes for which PAN and TAN are allotted are different. TAN is a unique identification number which is allotted to persons who are deducting or collecting tax at source on behalf of the Income Tax Department. PAN is a unique number allotted to assessees like individuals, companies etc.
36.What is the procedure to apply for TAN online?
Ans. You can apply for TAN online at the NSDL-TIN website. You can then fill and submit the form online. Once you click on button ‘submit’, an acknowledgment containing a unique 14 digit acknowledgment number is generated on the screen. You should print this acknowledgment, sign it and despatch it to NSDL at the address mentioned on NSDL-TIN website along with the processing fee which is Rs. 50 + service tax (as applicable). Payment can be made by DD/cheque, payable at par in Mumbai, favouring NSDL-TIN .
37.How can the change in address or details on the basis of which TAN was allotted be communicated to Income Tax Department?
Ans. Any change or corrections in the data associated with the TAN, should be communicated to ITD by filing up ‘Form for Changes or Correction in TAN data for TAN allotted’ alongwith the necessary fees at any of the TINFCs, or at NSDL-TIN website.
38.What are the charges I have to pay while submitting the ‘Form for Changes or Correction in TAN data for TAN allotted’?
Ans. You have to pay Rs. 50 (plus service tax, as applicable) to NSDL/TIN-FC as processing fees while submitting your application at the TIN-FC or making online application.
39. If I change my address, should I inform ITD or should I apply for a new TAN?
Ans. Change of address within a jurisdiction does not change the TAN. However, it may involve a change in the Assessing Officer. Such changes must, therefore, be intimated to ITD so that the TAN database of ITD can be updated. In case of change of address from one jurisdiction to other (e.g. address changes from Bangalore to Mumbai) a new TAN needs to be applied for and previous TAN needs to be surrendered on allotment of fresh TAN.
4o. What can serve as proof of TAN in case one has lost the TAN allotment letter?
Ans. Printout of the webpage showing details of TAN, from the Income Tax Department’s website can serve as proof of TAN.
