Age Limit: Candidates age limit should be between 18-27 years as on 27-03-2014 for General Category (unreserved Application). Age relaxation will be applicable as per the rules.

Educational Qualification: Candidates should possess 10+2 standard or 12th class pass from a recognized university or Board of School Education or Board of Secondary Education with English as a compulsory subject (excluding vocational streams). The applicants should have studied local language of the State or Union Territory of the concerned Postal Circle or in Hindi as a subject at least in Matriculation level or equivalent.

Selection Process: Candidates would be selected based on their performance in written examination and computer/ typing test.

Have you Filed your Income Tax Return for Last Financial Year - Advantages and Disadvantages of Filing of Income Tax Return

It has been published in newspaper that Income Tax Department has identified  too many PAN's who have not filed their returns.   This data has been collected on the basis of  AIR, CBI data and TDS/TCS return data.  In the other words, Finance Ministry has reconciled income tax data and identify approx. 21.75 Lacs persons.   Overall each and every person who have Permanent Account Number and his income exceeds the threshold limit of Income Tax should submit his income tax return in time

Belated tax return :- As per the provisions of the Income Tax Act, 1961 (the ‘Act’), a tax payer who has not filed his tax returns within the due date or as per the time specified under a notice issued to him by tax authorities, may do so for a financial year before the expiry of one year from the end of relevant assessment year or before the completion of assessment, whichever is earlier. Thus, in case a tax payer has missed his due date of filing his returns by August 5, 2013 —for the financial year 2012-13, he could still file his tax return by March 31, 2015.

Penalty for non-filing:- If a tax payer fails to file his returns before the end of the relevant assessment year, then tax authorities may impose a penalty of Rs. 5,000. Therefore, it would be prudent for the tax payer who has missed the deadline to file his returns latest by March 31, 2014, to avoid any penalty.

Revised returns:- Furthermore, there may also be instances where returns have been filed by the due date and subsequently, the tax payer finds some error in the same. In such an event, he may file revised returns any time before expiry of one year from the end of the relevant assessment year or before the completion of the assessment, whichever is earlier.

Defective returns:- It is also possible that certain errors are observed by the tax department in the filing. Thus, where such authorities consider that returns of income are defective, they may intimate the anomaly to the tax payer and give him a chance to rectify it within 15 days from the date of such intimation or within such further period as may be specified. If the tax payer fails to right the wrong, then the returns filed by him shall be treated as invalid and the provisions of the Act shall apply as he has failed to file his tax returns.

Disadvantages of Filing a Late Return: 

As per Income Tax Department of India : “A tax return may be furnished any time before the expiry of two years from the end of the financial year in which the income was earned’. This means that if you earned your income during FY 2012-13, you may file a belated return anytime before 31st March, 2015 ”. But there are some disadvantages if you don’t file your returns on time . The disadvantages are as under : 
  • You will not be able to carry forward your Business loss (Speculation or otherwise) , capital loss , loss due to owning and maintaining of race horses.
  • Loss of Interest on refund : You may loose interest on refund u/s 244A specially in case if you are claiming a Major amount as refund.
  • You cannot revise your return.
  • late filing can delay processing for tax refunds.
  • Incremental Interest U/s. 234A – If the tax has not been paid before the end of the tax year concerned and you file the return late, incremental interest at the rate of 1% per month will be payable on the unpaid amount after the due date. This is in addition to the 1% per month interest for non-payment of advance tax, that is, tax due after tax deduction at source exceeding Rs 10,000. Thus, late returns can result in an additional interest burden.

New Rebate of Income Tax u/s 87-A up-to Rs. 2000/- for Financial Year 2013-14

The Income Tax Department has started a new Section 87-A. Under this Section an individual , HUF’s, AOP & BOI under the Income Tax Act, 1961 will be eligible for Rebate in Income Tax  upto Rs. 2000/- from this Financial Year 2013-14.  Here are some FAQ's in this regard : 

Q 1. Whether basic exemption limit for Individuals, HUF’s, AOP & BOI under the Income Tax Act, 1961 has been raised from Rs. 2,00,000/- to Rs. 2,20,000/-

Ans. NO, the basic exemption limit remains unchanged at Rs. 2 Lakh for FY 2013-14 (AY 2014-15).

Q 2. In the Budget 2013 Speech, The Finance Minister had said, “Nevertheless, I am inclined to give some relief to the tax payers in the first bracket of Rs. 2 Lakh to Rs. 5 Lakh. Assuming an inflation rate of 10% and a notional rise in the threshold exemption from Rs. 2,00,000/- to Rs. 2,20,000/- I propose to provide a tax credit of Rs. 2,000/- to every person who has a total income up-to Rs. 5 Lakh. 1.8 crore tax payers are expected to benefit to the value of Rs. 3,600 crore.”

So doesn't it mean that the exemption has been raised by Rs. 20,000 and tax relief of Rs. 2,000/- given to every person?

Ans. No, it doesn't mean that!!!,As clarified in Q1 above ,Basic Exemption Limit has not been increased.

Q 3. So what is the point? Many people are saying that the exemption has been raised by Rs. 20,000/-. I am confused!

Ans. It means that though threshold exemption remains unchanged, tax benefit of upto Rs. 2,000/- is given.

Q 4. How that is made possible?

Ans. This has been made possible by inserting a new section 87A in the Income Tax Act,1961 which allows REBATE of upto Rs. 2,000/- from the income tax payable.

Q 5. Whether there is any condition for availing this benefit?

Ans. Yes, this benefit is available only if the income doesn't exceed Rs. 5 Lakh.

Q 6. Say my income is Rs. 5,50,000/- and I have paid Life Insurance premium of Rs.50,000/-. Will I be eligible to claim the rebate?

Ans. Yes, because the ‘Total Income’ after deducting all the deductions available under Chapter VI from the ‘Gross Total Income’ shall not exceed Rs. 5 Lakh.

Q 7. That’s great!! I am filing IT returns for myself and as Karta of HUF, so I can take total benefit of Rs. 4,000/-.

Ans. No, this rebate is available ONLY to an ‘INDIVIDUAL’ tax payer, resident in India.

Q 8. But in the Budget Speech, as quoted above, the FM used the words ‘I propose to provide a tax credit of Rs. 2,000/- to every person..” and person also includes a HUF?

Ans. The words used in the budget speech are for general understanding and have no statutory implications. As per new section 87A,
“An assessee, being an individual resident in India, whose total income does not exceed five hundred thousand rupees, shall be entitled to a deduction, from the amount of income-tax (as computed before allowing the deductions under this Chapter) on his total income with which he is chargeable for any assessment year, of an amount equal to hundred per cent of such income-tax or an amount of two thousand rupees, whichever is less.”

Q 9. Ohhh… but is it available to both Male and Female assesses? 

Ans. Yes.

Q 10. How will this benefit a senior citizen (age 60 or above) because the exemption limit in his case is already Rs. 2,50,000/- i.e. in excess of Rs. 2,20,000/-?

Ans. Tax Rebate of Rs. 2,000/- is also available to a senior citizen, if the total income is Rs. 5 Lakh or less. Effectively, it means, a senior citizen, both male and female, need not pay any tax on total income of upto Rs. 2,70,000/-. However, this benefit is not available to a super senior citizen (age 80 or above) as his total income up to Rs. 5 Lakh is already fully exempted.

Q 11. The rebate of Rs. 2000/- is available from which year?

Ans. The new section has been inserted with effect from the 1st day of April, 2014 means it is applicable for Assessment Year 2014-15 and thereafter. In simple words, when you will be filing your income tax return for the Financial Year 2013-14, you will get rebate of up to Rs. 2000/-

Q 12. Ok… Can we say that a new type of deduction has been provided for individuals?

Ans. A ‘deduction’ is given under Chapter VI from the gross total income, but this is a ‘rebate’ under Paragraph A of Chapter VIII of the Income Tax Act, 1961 which is deducted from the income-tax payable.

Q 13. Whether this rebate is also available to Non resident?

Ans: No , Rebate under section 87-A is not available to non resident persons.It is available only to resident of India subject to above conditions stated above.

Q 14. If the Total Income is say; Rs. 2,15,000/-, Income tax computes to Rs. 1500/- and Rebate of Rs. 2000/- allowed. Does it mean refund of balance Rs. 500 is available?

Ans. No refund is available because rebate is restricted to the amount of income tax payable.

Q 15. Whether Return is required to be filed when the Total Income is upto Rs. 2,20,000/- and after rebate, no tax is payable?

Ans. Yes, Income Tax Return is required to be filed as usual.In fact Income tax return is required to be filed if your Gross Total Income(Income before deduction u/s 80C to 80U) is more than exemption limit.

Save Income Tax by 7 Ways for Salaried Employees (Financial Year 2014-15)

At the end of every financial year, many tax payers frantically make investments to minimize taxes, without adequate knowledge of the various available options. The Income Tax Act offers many more incentives and allowances, apart from the popular 80C, which could reduce tax liability substantially for the salaried individuals. Here are seven smart tips to help you save more and reduce taxes. 

1. Salary Restructuring 
Restructuring your salary may not always be possible. But if your company permits, or if you are on good terms with your HR department, restructuring a few components could reduce your tax liability. 
  • Opt for food coupons instead of lunch allowances, as they are exempt from tax up to Rs. 50 per meal 
  • Include medical allowance, transport allowance, education allowance, uniform expenses (if any), and telephone expenses as part of salary. Produce bills of actual expenses incurred for these allowances to reduce tax 
  • Opt for the company car instead of using your own car, to reduce high prerequisite taxation. 

2. Utilizing Section 80C 
Section 80C offers a maximum deduction of up to Rs. 1,00,000. Utilize this section to the fullest by investing in any of the available investment options. A few of the options are as follows: 
  • Public Provident Fund 
  • Life Insurance Premium 
  • National Savings Certificate 
  • Equity Linked Savings Scheme, 5 year fixed deposits with banks and post office
  • Tuition fees paid for children's education, up to a maximum of 2 children 

3. Options beyond 80C 
If you have exhausted your limit of Rs. 1,00,000 under section 80C, here are a few more options: 
  • Section 80D - Deduction of Rs. 15,000 for medical insurance of self, spouse and dependent children and Rs. 20,000 for medical insurance of parents above 65 years 
  • Section 80G- Donations to specified funds or charitable institutions. 

4. House Rent Allowance 
Are you paying rent, yet not receiving any HRA from your company? The least of the following could be claimed under Section 80GG: 
  • 25 per cent of the total income or 
  • Rs. 2,000 per month or 
  • Excess of rent paid over 10 per cent of total income This deduction will however not be allowed, if you, your spouse or minor child owns a residential accommodation in the location where you reside or perform office duties. 

If HRA forms part of your salary, then the minimum of the following three is available as exemption: 
  • The actual HRA received from your employer 
  • The actual rent paid by you for the house, minus 10 per cent of your salary (this includes basic dearness allowance, if any) 
  • 50 per cent of your basic salary (for a metro) or 40 per cent of your basic salary (for non-metro).  

5. Tax Saving from Home Loans 
Use your home loan efficiently to save more tax. The principal component  of your loan, is included under Section 80C, offering a deduction up to Rs. 1,00,000. The interest portion offers a deduction up to Rs. 1,50,000 separately under Section 24. 

6. Leave Travel Allowance 
Use your Leave Travel Allowance for your holidays, which is available twice in a block of four years. In case you have been unable to claim the benefit in a particular four- year block, you could now carry forward one journey to the succeeding block and claim it in the first calendar year of that block. Thus, you may be eligible for three exemptions in that block. 

7. Tax on Bonus 
A bonus from your employer is fully taxable in the year in which you receive it. However request your employer for the following: 
  • If you anticipate tax rates to be reduced or slabs to be modified in the subsequent year, see if you could push the bonus payment to the subsequent year 
  • Produce your tax investment details well before, to prevent your employer from deducting tax on bonus before handing it over.

Due Date to file ITR-V for the Assesment Year 2009-10, 2010-11 and 2011-12 extended up to 31.03.2014

ITR-V is required to be submitted by assessee with the Income Tax Department with in 120 days from uploading of the Income Tax Return at Income Tax e-filing site who has furnished his/her Income Tax return online without digital signature. It's a good news for those who have filed their Income Tax Return for the Assesment Year 2009-10, 2010-11 and 2011-12 in ONLINE mode and could not submit their ITR-V due to any reason can now submit their ITR-V with the Income Tax Department up-to 31.03.2014. If the Income Tax Return is filed in ONLINE mode then it is necessary on the part of retrun filer to submit the ITR-V form in time which is generated after filing of Tax Return. Now CBDT has again extended the Due date to file ITR-V for AY 2009-10, 2010-11 and 2011-12  up to 31.03.2014. The due date has been extended many time earlier also but still many online returns are yet to processed due to non submission of ITR-V by the assesees. The Income Tax Department has issued a Circular in this regard which is produced as under :

Subject: - Non-Filing of ITR-V in returns with refund claims-relaxation of time-limit for filing ITR-V and processing of such returns -Regarding.

Several instances of grievances have come to the notice of the Board stating that a large number of returns-of-income for Assessment Year ('AY') 2009-2010, which were electronically filed without a digital signature in accordance with procedure laid down under the Income-tax Act, 061 ('Act'), were not processed as such returns became non-est in law in view of Circular No. 3 of 2009 of CBDT dated 21.05.09. Paragraphs 9 and 10 of the said Circular laid down that 1TR-V had to be furnished to the Centralised Processing Centre ('CPC'), Bengaluru by post within 30 days from the date of transmitting the data electronically and in case, 1TR-V was furnished after the stipulated period or not furnished, it was deemed that such a return was never furnished. It was claimed by some of the taxpayers that despite sending ITR-V through post to CPC within prescribed time-frame, the same probably could not reach CPC and thus such 4eturns became non-est. Since ITR-V was required to be sent through (ordinary) post at a 'post box' address, there were no despatch receipts with the concerned senders in support of their claim of having furnished 1TR-V to CPC within prescribed time limit.

2. Subsequently CBDT extended the time-limit for filing ITR-V (re1ati4 to Income-tax returns filed electronically without digital signature for AY 2009-2010) upto 31.12.2010 for 120 days from the date of filing, whichever was later. It also permitted sending of ITR-V either by ordin4ry or speed post to the CPC. However, for the AY 2009-10, some cases were still reported where return was declared non-est due to non-receipt of ITR-V by CPC even within such extended time-frame and conseq4ently the refunds so arising continue to remain held up.

3. Likewise, for AY's 2010-11 and 2011-12, though relaxation of time for furnishing ITR-V was granted
by Director General of Income Tax (Systems), it has been noticed that a large number of such electronically filed returns still remain pending with Income-tax Department for want of receipt of valid ITR-V Certificate at CPC.

4. The matter has been examined. In order to mitigate the grievances of the taxpayers pertaining to non
receipt of tax refunds, Central Board of Direct Taxes, in exercise of powers under section 119(2)(a) of the Act, hereby further relaxes and extends the date for filing ITR-V Form for Assessment Years 2009-10, 2010-11 and 2011-12 till 31.03.2014 for returns e-Filed with refund claims within th4 time allowed under section 139 of the Act The taxpayer concerned may send a duly signed copy of 1TR-V to the CPC by this date by speed post. In such cases, Central Board of Direct Taxes also relaxes the time-frame of issuing the intimation as provided in second proviso to sub section (1) of Section 143 of the Act and directs that such returns shall be processed within a period of six months from end of the month in which ITR-V is received and the intimation of processing of such returns shall be sent to the assessee concerned as per laid down procedure. 

5. Provision of sub-section (2) of section 244A of the Act would apply while determining the interest on such refunds. 

6. The taxpayer concerned may ascertain whether ITR-V has been received in the CPC, Bengaluru or not by logging on the website of Income-tax Department - http:/incometaxefiling.gov.in/e-Filing/Services/lTR-V Receipt Status.html by entering PAN No. and Assessment Year or e-Filing Acknowledgement Number. Alternatively, status of ITR-V could also be ascertained at the above Website under 'Click to view Returns/Forms' after logging in with registered e-Filing account. In case ITR-V has not been received within the prescribed time, status will not be displayed and further steps would be required to be taken as mentioned above.

Seventy Three New Trains Introduced - Highlights of Interim Railway budget 2014-15

The Interim Railway Budget 2014-15 has been presented in the Parliament by the Minister of Railways Shri Mallikarjun Kharge. As expected, the budget was passenger friendly as the success of e-booking of tickets has surpassed all expectations, and now train movements can also be tracked online to find the exact location and running. Railways Minister said given the promising trend of loading, the target has been scaled up to about 1052 million tonnes from the budget target of 1047 million tonnes and freight earnings targets revised to Rs 94,000 crore. He announced that an independent Rail Tariff Authority is being set-up to advise the Government on fixing of fares and freight. Moreover 73 (Seventy three) new trains are being introduced which includes 17 Premium trains, 39 Express trains, 10 Passenger trains, 4 MEMU and 3 DEMU in this year’s Interim Railway Budget. Three trains will be extended and frequency of same number of trains will be increased.

No increase in rail fare and freight has been proposed in the Interim Rail Budget for 2014-15. Presenting the Budget in Parliament today, the Minister of Railways Shri Mallikarjun Kharge announced 72 new trains, extension of three trains and increase in frequency of three trains. The Minister announced that there will be no more unmanned crossings. A Rail Tariff Authority has also been announced. A number of measures for safety and security of passengers like portable fire-extinguishers in coaches and induction based cooking in pantry car have been proposed in the Budget.

The Budget presented today envisages investment of Rs. 64,305 crore as against Revised Estimates for 2013-14 of Rs. 59,359 crore. Anticipating a healthier growth of economy, the freight traffic target is proposed at 1,101 million tonnes, an increment of 49.7 million tonnes over the current years’ revised target of about 1052 million tonnes. The Gross Traffic Receipts have been projected at Rs. 1,60,775 crore . Working Expenses have been proposed at Rs. 1,10,649 crore, which is Rs. 13,589 crore higher than the Revised Estimates for the current year.

Highlighting the passenger friendly initiatives of Indian Railways, the Minister said the success of e-booking of tickets has surpassed all expectations, and now train movements can also be tracked online to find the exact location and running. Besides, 51 Jan-Ahaar outlets for sale of Janta Meals have been set up; 48 passenger escalators have been commissioned at railway stations and 61 more are being installed and air-conditioned EMU services will commence in Mumbai area by July 2014. 

Railways Minister announced that Itanagar, capital of Arunanchal Pradesh will soon be on rail map in this financial year, as Harmuti-Naharlagun line is expected to be commissioned shortly. The state of Meghalaya is also all set to come on the Railway map in this financial year, as Dudhnoi – Mehendipathar line is getting completed by March 2014.

Briefing about Railways efforts for moderation of its network Sh. Kharge said a joint Feasibility Study for Mumbai-Ahmadabad High Speed corridor, started in December 2013, will be completed in 18 months. Besides the High Speed project, Indian Railways also intend to explore low cost options for raising speeds to 160-200 kmph on existing select routes like Delhi-Agra and Delhi-Chandigarh.

The Minister said that Investment in Railways is being stepped up by partnership with the private sector. PPP projects related to rolling stock manufacturing units, modernization of railway stations, multi-functional complexes, logistics parks, private freight terminal, freight train operations, liberalized wagon investment schemes and Dedicated Freight Corridors are in the pipeline. Apart from attracting private investments from domestic investors in rail sector, a proposal is under consideration of the Government to enable Foreign Direct Investment (FDI) to foster creation of world class rail infrastructure.

Reiterating Railways’ commitment or safety and security of passengers the Minister said several measures have been and are being taken for its further strengthening. Manning or elimination of all unmanned level crossings has been taken up and planning for induction of indigenous developed Train Collision Avoidance System (TCAS) and provision of Vigilance Control Device (VCD) in all electric and diesel locomotives is being introduced. He said that a Comprehensive Fire and Smoke Detection System is on trial on two rakes of Rajdhani Express trains. This will be extended to all major passenger trains. Provision of portable fire extinguishers in AC coaches, Guard-cum-luggage break vans, pantry cars and locomotives. Introduction of electrical induction based cooking appliances in replacement of LPG in pantries is being taken up.

With a view to improving aesthetic ambiance along the track close to the approach of major stations, the Railways Minister announced creation of ‘Green Curtains’ at Agra and Jaipur stations on pilot basis. He said that bio-toilets have been introduced in about 2,500 coaches. It is proposed to increase the coverage progressively.

House Rent Allowance (HRA) Exemption Calculation 2014-15 for Salaried Persons

If a person is doing job in Government/ Public/ Private Sector and getting House Rent Allowance (HRA) as a part of his/her salary along with other allowance, then he/she could claim exemption of House Rent Allowance from his Gross Taxable Income as provided by the Income Tax Department. But the exemption is restricted only for those persons who are not living in their own house i.e the person should be living in a Rented Accommodation. House Rent allowance (HRA) exemption calculation is most easiest calculation in income tax. Here is a set of FAQ on HRA exemption calculation and hope it will definitely helpful for many to understand the topic in simple way.

HRA exemption calculation is made basically on four variable i.e. House rent allowance received, House rent paid, Salary Received and Location of the house.

As per section 10(13A) read with rule 2A , least of the following three will be exempted
  1. House Rent Allowance (HRA) received.
  2. 50% of salary in case of residential accommodation taken on rent is situated in Bombay, Calcutta, Delhi, or Madras (Chennai) and 40 % of salary in in any other case.
  3. Rent paid in excess of 10 % of Salary.

FAQ's regarding exemption of House Rent Allowance (HRA)

Q. How to calculate HRA exemption i.e in monthly or yearly mode?

Ans: HRA exemption calculation is depended on four variable as shown above, if all of these remains same in a year then you can calculated it on yearly basis otherwise for each set of of variable, you have to do separate calculation. If DA is changed then your exemption of HRA will also effect. 

Q. I have received salary arrears of last years. For HRA exemption arrears is to be included or not?

Ans : For HRA exemption ,salary of the relevant period for which we are calculating exemption is to be taken .so arrears are not be included for HRA purposes .salary on due basis is to be taken.

Q. As per Sixth Pay commission ,Grade pay has been added in Basic Pay ,whether it is part of salary for Calculation of HRA exemption ?

Ans: As per sixth pay commission

Basic pay = Pay in pay band plus Grade Pay
so according to 6th CPC Grade Pay is part of Basic Pay and Basic Pay you are referring is actually pay in pay band . In brief Grade Pay is to be included for salary as per HRA exemption calculation.

Q. I am a Doctor and receiving NPA (non practice allowance) and it is also considered in most of the retirement benefits . Is NPA to be included in salary for HRA exemption ?

Ans.No, it is not. As per section 10(13A) only DA is to be included in the salary for HRA exemption calculation.

Q.To claim HRA exemption ,my DDO is asking for Rent payment receipt from my landlord .what should I do?

Ans: Give him ,what he asking for .yes produce the house rent payment receipt to him.Actually DDO(drawing and disbursing officer) is responsible to deduct TDS from salary ,so to avoid penalties at later stage ,he has to verify all the saving proofs ,rent receipt etc from the employee.and if employee is unable to produce the same then DDO is empowered to reject the claim of the employee.

Q. Is it necessary to give Landlord's PAN number on rent receipt ?

Ans: Landlord's PAN is mandatory if  payment exceeds more than Rs 1,00,000 per annum w.e.f. financial year 2013-14.  Landlord PAN is mandatory if rent paid is in excess of Rs  180000/- for Financial Year 2011-12 & 12-13)

Q. My friend have informed me that there is a cut off amount for rent paid after which only, rent receipt is required.Is it true?

Ans: Yes and No .Yes because there is a cut off Limit .No because the cut off limit is for HRA received PM and not for House rent paid.Those employees ,who are receiving house rent up to 3000 per month are not required to submit Rent receipt to DDO.I repeat this 3000/- limit is for house rent received and House rent paid in this case may be more than 3000/-.

Q. I have produce rent receipt to my DDO but he his now asking for rent agreement ?

Ans: Rent receipt is enough to claim the HRA exemption , and I request to your DDO, please do not ask for rent agreement . On the reverse, if employee has submitted a rent agreement only then DDO should ask for rent receipt as the rent agreement is not a proof of payment.

Q. My DDO /employer has rejected my HRA exemption and deducted the tax accordingly. Further nothing has been mentioned about HRA exemption in Form 16 issued by the employer. Can I claim HRA exemption while filing my Income tax return?

Ans: Yes , you can claim the HRA exemption. If employer has not considered your HRA exemption claim then you can claim the same while filing your income tax return even nothing has been mentioned about HRA/HRA exemption in Form 16.

Q. I have paid rent to my Wife/Father. Can I claim HRA exemption?

Ans: If this is actual payment then Yes you can claim rent exemption even if the rent is being paid to your family members. But remember House must be on their name or he/she must be authorize to receive rent on the property. Though the above point have no relation with HRA exemption but tax planning should be done carefully and remain with in limit .

Q. .Both of us (husband /wife) are working and leaving in same house on rent .Can we both claim HRA exemption ?

Ans: Yes, but subject to that rent is shared/paid by both of you and individually, both of you can claim exemption up to share of rent paid actually paid by you.

Q. I am claiming HRA for three months and moving to own residence after that. When the HRA is calculated, will it take into consideration the basic for three months or basic pay for entire year? i.e., will the calculation be = Actual rent - 10% of annual basic or Actual rent - 10% of three month basic ?

Ans: Calculate salary & House rent paid month to month basis and then calculate full year year exemption by aggregating all month in your case exercise is required to be done for three months only.

Q. Can I get HRA exemption and interest of House loan and principal amount both the amounts, if i am not staying in my own house because it is in other city

Ans :Yes, you can claim both HRA & House loan interest if you are staying at other place due to employment.

Q. I am paying rent for house at Delhi where my family is living and also paying rent for accommodation in another city where I am employed. Can I claim HRA exemption for total rent paid by me for both the accommodation?

Ans: As per rule 2A , rent paid is to be considered for only one house in which assessee is residing and paying the rent . So you can claim rent for only where you are residing , not on house in which family is living

Q. What if I have a house in my name , and another house joined to my house in mother name can I get HRA benefit if I pay rent to my mother ?

Ans: You can claim HRA only if you have actually paid it , in this case also, as you have paid rent to your mother, then you can claim HRA exemption benefit. Further if you show House rent payment and claim HRA exemption then your own house will be deemed to be let out and you have to add rent in your income for that house.so on one side your income will be reduced by HRA exemption ,on the other side you have pay tax on deemed rent for house owned by you. Overall no benefit in doing this.

Q. I have been taken a House Building Loan and my house e is under construction. I am paying 12000 as EMI. Can I take HRA exemption?

Ans: You can Claim HRA benefit till your house completed subject to that you have actually paid the Rent . Further in future also, you can continue to claim HRA benefit, if your house is at a location, other than where you are employed or you will give house for a rent . Moreover you can claim House loan benefit in Financial Year 2009-10 only if your house is completed by 31st march, 2010.

Explanation.—For the removal of doubts, it is hereby declared that nothing contained in this clause shall apply in a case where - 

(a) the residential accommodation occupied by the assessee is owned by him ; or
(b) the assessee has not actually incurred expenditure on payment of rent (by whatever name called) in respect of the residential accommodation occupied by him.

Rule 2A as per Income Tax Rules(Limits for the purposes of section 10(13A)).

2A. The amount which is not to be included in the total income of an assessee in respect of the special allowance referred to in clause (13A) of section 10 shall be

(a) the actual amount of such allowance received by the assessee in respect of the relevant period; or

(b) the amount by which the expenditure actually incurred by the assessee in payment of rent in respect of residential accommodation occupied by him exceeds one-tenth of the amount of salary due to the assessee in respect of the relevant period; or

(c) an amount equal to

(i) where such accommodation is situate at Bombay, Calcutta, Delhi or Madras, one-half of the amount of salary due to the assessee in respect of the relevant period; and

(ii) where such accommodation is situate at any other place, two-fifth of the amount of salary due to the assessee in respect of the relevant period,

(d) [***]

whichever is the least.

Explanation : In this rule

(i) salary shall have the meaning assigned to it in clause (h) of rule 2 of Part A of the Fourth Schedule;

(ii) relevant period means the period during which the said accommodation was occupied by the assessee during the previous year.
