House Building Loan : Conditions for Claim of Deduction of Interest on Borrowed Capital for Computation of Income From House Property Section 24(b)

Are you planning to construct a House or purchase a built up house? Are you a Tax-Payer ? Then you can also save Tax if you construct the House or purchase a built up house by taking a Loan from a Bank or from the institution where you work. There will be 2 type of deductions you can claim i.e. one for the Principal amount you pay and the second is for interest paid on borrowed capital. Section 24(b) of the Act allows deduction from income from houses property on interest on borrowed capital as under:-

(i) the deduction is allowed only in case of house property which is owned and is in the occupation of the employee for his own residence. However, if it is actually not occupied by the employee in view of his place of the employment being at other place, his residence in that other place should not be in a building belonging to him.

In case of Serial No. 3 above

(a) The acquisition or constructing of the house should be completed within 3 years from the end of the FY in which the capital was borrowed. Hence it is necessary for the DDO to have the completion certificate of the house property against which deduction is claimed either from the builder or through self-declaration from the employee.

(b) Further any prior period interest for the FYs up-to the FY in which the property was acquired and constructed shall be deducted in equal installments for the FY in question and subsequent four FYs.

(c) The employee has to furnish before the DDO a certificate from the person to whom any interest is payable on the borrowed capital specifying the amount of interest payable. In case a new loan is taken to repay the earlier loan, then the certificate should also show the details of Principal and Interest of the loan so repaid.

Central Teacher Eligibility Test (CTET) Feb-2014 for Primary/ Elementary Teachers

The Central Board of Secondary Education (CBSE), Delhi has issued a notification for Central Teacher Eligibility Test   (CTET)  Feb-2014. The Board will conduct a All India Examination in this regard  for a person to be eligible for appointment as a teacher for classes I to VIII on 16/02/2014. The interested candidates can apply in ONLINE mode only through the link provided on the official website of the Board. No other means/mode of application will be accepted. If a candidate qualifies the test, the Validity Period of CTET qualifying certificate for appointment will be seven years from the date of declaration of its result for all categories. There is no restriction on the number of attempts a person can take for acquiring a CTET Certificate. A person who has qualified CTET may also appear again for improving his/her score. A candidate can get a duplicate copy of Marks Statement or Eligibility Certificate by paying the following fees by way of Demand Draft in favour of “Secretary, Central Board of Secondary Education” drawn on any nationalized bank and payable at Delhi:

The Normal Course (within 2 weeks) Time is for issue of Duplicate documents and the Charges are Rs.200/-. For getting the certificate Within two working days the fees will be carged is Rs.400/-. 

The CTET shall apply to schools of the Central Government (KVS, NVS, Central Tibetan Schools, etc.) and schools under the administrative control of UT’s of Chandigarh, Dadra & Nagar Haveli, Daman & Diu and Andaman & Nicobar Islands and NCT of Delhi.

CTET may also apply to the unaided private schools, who may exercise the option of considering the CTET.

Schools owned and managed by the State Government/local bodies and aided schools shall consider the TET conducted by the State Government. However, a State Government can also consider the CTET if it decides not to conduct the State TET.

The candidates appearing in CTET will be issued Marks Statement. The Candidates securing 60% and above marks will be issued Eligibility Certificate.
School Managements (Government, Local bodies, Government aided and unaided) may consider giving concessions to person belonging to SC/ST, OBC, differently abled persons, etc., in accordance with their extant reservation policy.
Qualifying the CTET would not confer a right on any person for recruitment/employment as it is only one of the eligibility criteria for appointment.

Income Tax : Deduction on account of House Building Loan u/s 24(b) and 80C

If you have taken a Loan for construction of House or to purchase of a house which should be a self occupied house property, then there is deduction available U/s 24(b) of the Income Tax Act-1961. The admissible deduction is up to Rs. 150,000/- against the interest payable on the loan and up to Rs. 1,00,000/- against principal amount u/s 80C. There is no change in the deduction available towards interest & principal repayment of the housing loan. The same has been discussed at length in earlier issues of Tax Talk as well.

U/s 24(b) of the Income Tax Act-1961, deduction up to Rs. 150,000/- is admissible against the interest payable on the loan availed for purchase / construction of the self occupied house property.  [However, the acquisition or construction of the house property should be completed within 3 years from the end of financial year in which home loan was taken; otherwise, the deduction would be restricted to Rs. 30,000/-]
In respect of loan taken prior to 01.04.1999, the deduction can’t exceed Rs. 30,000/- for the self occupied house property.

Pre-construction period Interest [Loan taken against/for under construction property]:

The interest paid during the period the house property is under construction is not deductible in the year of payment. Interest in respect of pre-construction period is deductible in five equal annual installments commencing from the previous year in which the house is constructed/acquired. For this purpose “pre-construction period” means the period commencing on the date of borrowing and ending on March 31 immediately prior to the date of completion of construction /acquisition.

In respect of self occupied house property, it may be noted that for purchase / construction, interest deduction is admissible up to Rs. 1.50 Lacs whereas there is a ceiling of Rs. 30,000/- only in respect of loan taken for Repairs/ Renewal or Reconstruction.

Principal repayment of the home loan:

In respect of principal repayment of home loan, deduction is admissible u/s 80C. Overall deduction U/s 80C (which also includes deduction towards LIC/ PPF, Tuition fees etc) can’t exceed Rs. 1 Lacs.

Educational Qualifications:  Candidates should be qualified in Punjab State Teacher Eligibility Test (PSTET) . Candidates should have done degree in relevant discipline.kindly view advertisement for detailed information.

Age Limit: Candidates age should be minimum 18 years and maximum 38 years as on 01.01.2013.
(Relaxation in Age will be given as per Government Rules.)
