EPFO - TDS is compulsory on withdrawal of premature Provident Fund w.e.f. 01.06.2015

Provident fund withdrawals before five years of completion of service will now attract income tax ranging between 10 per cent and 34.608 per cent.

A new provision in the Finance Act, 2015 that becomes effective from June 1 has mandated that premature withdrawals of retirement savings that exceed Rs 30,000 before completion of five years of service will be subject to tax deducted at source.

Tax would be deducted at the rate of 10 per cent if the subscriber provides the PAN number but the levy would go as high as the maximum marginal rate of 34.608 per cent if the subscriber does not provide his PAN number at the time of withdrawal.

The Employees Provident Fund Organisation (EPFO) is understood to be discussing the issue with the finance ministry to reconsider the issue but it has issued a notification and detailed guidelines to field offices on tax deduction.

“Income Tax shall be deducted at source… if at the time of payment of the accumulated PF balance is more than or equal to Rs 30,000, with service less than five years,” Sanjay Kumar, financial adviser said in a missive.


Exemption from TDS would be given to senior citizens and subscribers with no taxable income, provided they submit the required forms, the EPFO has said, adding that in these cases too tax would be levied if the amount withdrawn exceeds Rs 2,50,000 and Rs 3 lakh, respectively.

However, workers whose service has been terminated due to his ill health, contraction or discontinuance of business of employer or other cause beyond the control of the member will also be exempt from paying TDS on such premature withdrawals.

TDS would also not be levied on transfer of retirement savings from one account of the member to another.

EPF - Submission Process for Online Claims

Employees' Provident Fund Organisation, India (EPFO) is going to introduces a new system to facilitate online submission of transfer claims by Members with an objective to make the transfer process transparent, efficient and comfortable for your employees. A member has an option to submit his claim either through his present employer or the previous one.  You can see all such claim requests with ease, verify/correct member details, approve and submit the requests online through this portal. For online submission of the claims, the Digital signature (Class II or above) of the authorized person is required.

User name and password for this portal is same which is used in ECR portal by the establishments and accordingly may be used with high diligence.

To facilitate  the Revised Transfer Claim form for EPFO beneficiaries marking this as first step towards launch of online Transfer Claim facilities EPFO issued revised claim form .

Salient features of  revised claim /transfer form 
  • The form will be called Transfer Claim Form instead of Form 13 for easy comprehension by the beneficiaries. 
  • The form can be presented after verification, either through the present employer or previous employer. 
  • Earlier the form could be submitted after verification only through the present employer. 
  • This form can be submitted online as well as in physical form. The facility of online submission of this form will be given shortly after process of collecting the digital signature of the employer is completed. 
  • The facility to file physical form shall continue to cater to the needs of working class who do not have internet access. 
  • Employee will be allowed to submit their applications online, if their employer is having registered digital signature.
  • Online submission of form will introduce paperless process for claim settlement.

Here are some very important questions which could be in your mind about your Provident Fund which is being deducted from your Salary/Wages and how you can get the details from Employees' Provident Fund Organisation by registering ONLINE through the link provided on the official website on Member Portal. Employees' Provident Fund Organisation (EPFO) is a statutory bode under Ministry of Labour and Employment, Government of India which maintains all the record of Provident Fund being deducted out of your salary/wages. The Frequently Asked Questions (FAQ's) in this regard are as under :
What is Member Portal ?
Member Portal is for Employee, Where Employee can check own PF Status.

What is E-PassBook ?
E-PassBook is the employee Provident Fund status Book (PDF). Employee can check own PF status

Who can register on the member portal?
Any member of the employees’ provident fund can register. at the time of registration, details of the PF Account(s) is not required.

What are the advantages of registration?
Only a registered member can download his/her pf account Pass Book. Pass Book will be available for immediate download only for the active members for whom the employer has uploaded an electronic challan cum return (ecr) and remitted the dues. For members who have left the service before march 2012, the Pass Book will be made available if the member makes a request for the same on the portal. Pass Book of members having inoperative or settled accounts will not be displayed on the portal.

Can a member create his own user id and Password on the portal?
No. any chosen document number as in PAN, Aadhar, Passport, etc will be the user id and mobile number will be the Password. The member will not have to remember the user id and Password in such case.
Can a P.F. member working for an establishment exempted under the epf scheme also avail benefits under the portal?
No. The provident fund accounts in such case are maintained by the respective trust and Pass Book for such member cannot be displayed through the member portal.

A registered member has lost/changed his existing mobile number. can he/she change the mobile number on the portal?
Yes, he/she can change the mobile number. facility to edit the mobile number has been provided on the portal. The member has to login using his/her id and old mobile number and then edit the existing mobile number. He/she will get a pin through an sms on the new mobile number to complete the process.

What are the advantages of adding multiple document numbers on the portal?
The member may at any point of time be carrying any of the various documents such as pan, aadhar, Passport, bank Pass Book. adding the multiple numbers gives him/her an advantage of using any of the number to log in and download his/her Pass Book. He/she will also not have to remember as to which document he/she had used for registration.

If any document number is wrongly entered, can it be edited?
Yes, the number can be edited. However the document number used for log in at the time of editing is blocked. for example, if a member has logged in using his/her pan, he/she can edit any other document number but not the pan. For editing pan if wrongly entered he/she will have to log in with some other document number already added.

Why for each transaction the member has to get and enter the pin received on his/her mobile number?
This is to ensure that the portal is not misused by any other person who may know the document number and mobile number of any other member. The record of the mobile number used for registration and for each transaction will be maintained in the data base and in case of any complaint, action may be taken on the basis of the mobile number used. Thus this is only to safeguard the interests of the members.
A member has used one identity document to register and has forgotten the same. can he/she register again using his/her mobile number?
No. one mobile number can be used only for one registration. However he/she can click on the ‘forgot login’ link under the fields for document number and mobile number to get through sms his/her document details used for the registration.

How can a member download his/her Pass Book?
After login the member has to use the download e Pass Book link on the portal. He/she has to select the state under which the establishment is covered and then the EPFO office that maintains his/her account. he/she will be asked to enter the code number, account number and his/her name. if the Pass Book is available he/she will get a pin on his/her mobile number and on entry of the pin he/she will get the link for the Pass Book. He/she can open and save the Pass Book on his/her computer.

What entries will be shown in the Pass Book?
Month and date wise transactions made in member’s account will be displayed in the Pass Book from the year for which the annual accounts were updated for the establishment for the first time since computerization of the concerned field office. For example if the first annual accounts of member’s establishment were updated for the year 2008-09 by the concerned field office after its computerization, the Pass Book will display the opening balance for year 2008-09 and all transactions thereafter.

A member has left service but not applied for settlement of his account. can he/she download his/her Pass Book?
Members who has left service can make a request for their Pass Book through the member portal. once his/her request is accepted on the portal, he/she will receive an SMS when the Pass Book is made available on the portal. he/she can then login and download the Pass Book. Pass Book will however not be made available if the member’s account has become inoperative (no contribution received for 36 months or more) or if it is settled. Pass-Book will be available for immediate download for active members only for whom the employer has uploaded the Electronic Challan cum Return (ECR) and has made the payment.

The member has got the pin on his mobile number while downloading the e-PassBook. but the field for entry of the pin is not allowing entry. What to do?
The field for entry of pin allows enter only when the member has clicked on the check box with ‘i agree’ meaning that he/she is declaring that the account number he/she has entered is his/her account and that in case of any misuse or complaint his/her details can be used for suitable action.

A member working for an establishment exempted under the epf scheme wants to download his/her Pass Book. Is it possible?
No, the P.F. accounts of the exempted establishment are maintained by the respective trusts and Pass Book of such member cannot be displayed from this portal.
While downloading the e Pass Book a message appears “you have entered invalid members id or name”. What to do?
Please check whether you have entered the correct code & account number and/or name. in case yes, the name may not be matching as per the record in EPFO. In such case the member has to contact the concerned EPFO office.

The member has downloaded his/her Pass Book but there is some error in the name. What to do?
At present the name as appearing in the Pass Book cannot be changed.

A member has downloaded his/her e Pass Book. however there are several missing entries in the contributions. What to do?
The member should check first with the employer whether the returns for the month/year related to the missing entry has been submitted by him to the concerned EPFO office. In case yes then he/she can contact the concerned EPFO office regarding the missing details.

Member has downloaded his/her e Pass Book. however the contributions displayed are less than the actual dues as per his/her wages. What to do?
He/she should check with the employer as to what amounts have been shown in the returns. in case of any grievance, he/she should contact the concerned pf office.

A member has attempted to download the e Pass Book. he is not getting the pin. What to do?
He/she should check the message displayed on the screen. if the message states that pin has been sent and the pin is not received, it may be because the line is very busy. in such case it is advised to wait for some time and try again.

A member has two accounts in the same establishment? how can he/she download the Pass Book for both?
Out of the two accounts under the same establishment one will definitely be closed and the second account may be the active one. The member should apply in form 13 to get the old account transferred to the active one. after transfer the amount will be added to the active account and will be displayed in the Pass Book.

Can the member download the Pass Book of an account multiple times?
Yes. With the launch of electronic challan cum return the members account will be credited with the monthly contribution amount each month. The member can download the e-Pass Book any number of times (every month) to check the latest details.

A member has an active account but some of the earlier accounts have become inoperative. how can he/she get the details of such accounts through the portal?
e-Pass Book of inoperative accounts will not be displayed. however the member should apply in form 13 to get the earlier account transferred to the active account. In such case the details of the amount will appear in the Pass Book of the active account.

A member does not know the EPFO office under which his/her establishment is complying. how can he/she download his/her Pass Book?
The member can use the establishment search facility on the EPFO website to get the details of the office and also the code number of the establishment.

Download Your EPF e-PassBook


Friends,

EPF is being deducted from everyone's salary who are doing jobs in private sector / companies. One is not sure that the amount so deducted is being deposited to their EPF Account with Employer's contribution or not. Now to know your EPF balance a unique facility for EPF members to download their e-pass book each month has been started. For this you have to register online to view your EPF Account Passbook. The facility at present is only for the members for whom the employer has uploaded the Electronic Challan Cum Return for the wagemonth of May 2012 onwards. There is no need to create and remember any user id and password. You have to use your mobile number and any of your following identification proof number such as PAN, AADHAR, NPR (National Population Register), Bank Account, Voter ID, Passport or Driving License to register and thereafter to login. You can add multiple id numbers (one id against each of the listed types) and any one along with the mobile number can be used for the login.

Note:
  • One mobile number can be used for one registration only.
  • A registered member can view only one account details under one establishment. In case you are having more than one account under  one establishment, please apply for transfer through the Form 13.
  • One member can view up to a maximum of 10 accounts under different establishments. 
  • The 10 accounts can be viewed any number of times. Get your old accounts transferred to the current one by using the Transfer Form 13. 
  • Facility to display the accounts of inoperative accounts will be provided later through a request mode. 
  • The facility is not for the current members of establishments having exemption under the EPF Scheme 1952.
EPF Account Pass Book - View Online

The salient features of this facility are as under: 

The members shall be able to download their e-pass book each month, if they are active members and ECR is being uploaded by their employer.

In case of the members who are not active (left service) and have not settled their account or have not become inoperative, the facility to download the pass book on request basis shall be available.

The facility shall be available on www.epfindia.gov.in Any PF member can register himself/herself on the Member Portal (as shown below) by using his/her Photo Identification number such as PAN, Aadhar, NPR, Driving License, Passport, Voter ID, Ration Card and use the mobile number as the password. Thus the member will not be required to remember any user id/password. The member can add multiple id numbers after registration and can use any one for login.  Once registered, he/she can download the pass book by entering his/her account number. If available the pass book will appear for download.

In case not available a request will be created on the portal and once the pass book is uploaded by the respective field office, an SMS will be sent to the member to login and download the pass book. The e-pass book shall contain the transaction wise details in the member`s account (all credits and debits) since the month for which the details for the establishment have been processed in the new application software at the field offices. 

The facility, however is not available for the members under establishments that are exempted under the EPF Scheme 1952 (as the fund details are maintained by the Trust), Inoperative members (i.e in accounts where no contribution has been received during preceding 36 months).

Restrictions : -
  • Only one registration is permitted against one mobile number.
  • The member can download the passbook for only one account number under one establishment. Thus in case he/she has worked for different spells in one establishment with different account numbers, he/she has to apply for the transfer of the old account to the new so that the credit may be reflected in the e-pass book of the new account.
  • To view the amount balance against any inoperative account also the member should apply for transfer and then the transferred amount will reflect as credit in the present account of the member.

EPF Inquiry against Employers Time Barred After 7 Years

Retirement fund body EPFO has tightened the norms for initiation of its inquiries against employers and also set a time bar of seven years for such proceedings, a move which the trade unions have described as anti-worker.

The circular, which was issued by Central Provident Fund Commissioner (CPFC) R C Mishra on his last day in office (November 30), seeks to modify the provisions that result in harassment of employers and establishments.

In a worker friendly move, the circular also redefined the meaning of "basic wages" for the purpose of provident fund deductions and said, "All such allowances which are ordinarily, necessarily and uniformly paid to the employees are to be treated as the basic wages.

According to the circular, the inquiry against employers can only be initiated after, "actionable and verifiable information," is placed for consideration before the compliance officers.

The employer, it said, would be required to make available online the complete history of the establishment for the benefit of compliance officers.

The information to be provided should include the amount remitted and the number of employees engaged by the establishment.

The order of assessment to be issued by the EPFO, it said, should be 'speaking order' (with reasoning) and should not suffer from procedural infirmities.

With regard to the time period for initiating inquiry, it said, "no inquiry or investigation shall ordinarily go beyond seven years, i.e., it shall cover the period of default not exceeding preceding seven years."

The open assessment, inquiries and investigations serve no real purpose the circular said adding, "such inquiries often don't result in identification of beneficiaries and only tend to harass the employers and establishments."

Opposing the circular, the trade union leaders have decided to press the government for withdrawal of the circular.

"This circular which has time-barred such inquiries is anti-worker and we would Lodge our protest with the Labour Secretary," a EPFO trustee and Secretary Hind Mazoor Sabha A D Nagpal said.

Echoing similar views, another EPFO trustee and Secretary of All India Trade Union Congress (AITUC)    D L Sachdeva said: "We will demand withdrawal of this circular and soon write to Labour Secretary about this."

EPFO has over 50 million subscribers and manages a corpus of over Rs 3.5 lakh crore.

EPF Account Pass Book - View Online

Employees' Provident Fund Organisation, India has started a very good utility to watch you EPF Account Pass Book Online. What one has to do is just create a Login on the official website of EPFO. The Department has made it very easy to remember your User Id and Password as you have to use your mobile number and any of your following identification proof number such as PAN, AADHAR, NPR (National Population Register), Bank Account, Voter ID, Passport or Driving License to register and thereafter to login. You can add multiple id numbers (one id against each of the listed types) and any one along with the mobile number can be used for the login. Only one Registration is allowed on One Mobile Number. If a registered member has worked under many organisations he can view only one organisation account.  Get your old accounts transferred to the current one by using the Transfer Form 13. Inoperative Accounts can not be viewed at this stage. This facility will be activated later on. The establishments which have exemption under the EPF Scheme 1952 can not avail this facility.

Q 24. A Member Has An Active Account But Some Of The Earlier Accounts Have Become Inoperative. How Can He/She Get The Details Of Such Accounts Through The Portal?

E Pass Book Of Inoperative Accounts Will Not Be Displayed. However The Member Should Apply In Form 13 To Get The Earlier Account Transferred To The Active Account. In Such Case The Details Of The Amount Will Appear In The Pass Book Of The Active Account.

Q 25. A Member Does Not Know The EPFO Office Under Which His/Her Establishment Is Complying. How Can He/She Download His/Her Passbook?

The Member Can Use The Establishment  Search Facility On The EPFO Website To Get The Details Of The Office And Also The Code Number Of The Establishment.

Know your EPF Balance 2012


Friends,

Most of are working in some Organisation/ Institute/ College/ School/ Factories and so many Firms/ Industries. When we receive our salary a part on account of PF is being deducted from there. Before 01/07/2011 no one can easily know his/her PF so deducted is being deposited into their respective account or not. But now the Employees' Provident Fund Organisation, India has started a very good facility to Know Your PF balance from anywhere in India just using Internet and by login to this site and giving some relevant information regarding your PF Account you can easily know your PF Balance.  Just follow the instructions to get your EPF Account Balance to your Mobile through SMS.

Please click on the following link to know the balance in your EPF Account up to the date, the accounts are updated, which also includes the latest approved transactions of settlement/advances/transfer-in/transfer-out, if any.

Select the EPFO office where your account is maintained and furnish your PF Account number.

Leave the extension field blank, in case your account does not have one.

You will be asked to enter your name and mobile number. The given mobile number will be recorded along with the PF Account Number.

On successful submission of above information, the details will be sent through SMS to the given mobile number

Select your PF Office State and Select your EPFO Office as given in the Picture. 

In the next screen you have to provide your PF Account details Like as PF Account Number, Name and Mobile No. and then press I Agree as given in the below picture. 

Your PF Account balance will be send to you by SMS.

Now you can check your account at your own.

Employee's Provident Fund Organisation (EPFO) Recruitment 2012


Friends,

Candidates having a Graduate Degree from a recognized University or its equivalent and having a speed of at least 5000 key depressions per hour for Data Entry Work can apply for the posts of Social Security Assistants in the Employee's Provident Fund Orgnisation (EPFO) under Ministry of Labour & Employment, Government of India. The organisation has issued a new notification regarding this. EPFO main office located at Bhavishya Nidhi Bhavan, 14, Bhikaiji Cama Place, New Delhi-110066. Candidates can apply in the ONLINE mode only. No other mean/mode of application will be accepted. There are a total no of 1867 Regular posts of Social Security Assistants plus 76 Posts for sports quota which will be distributed state wise.

Selection Procedure

First Employees' Provident Fund Organisation (EPFO) will take written test on 15th April 2012. Second they will test your skill with Skill test to assess speed and accuracy for Data Entry Work. Min requirement is 5000 key depressions per hour.

Application Fee : Rs. 315/- ( For General and OBC Candidates)
                           : Rs.  90/- ( For SC/ST/PH Candidates)
